Terms of Service

CabalSpy Alpha — paid access to trading signals. Last updated 13 September 2026.

1. Who you are contracting with

CabalSpy Alpha ("the Service") is operated by:

Davis von Löwe Kiedrowski
Sole proprietorship (Einzelunternehmen)
Walsroder Straße 158, 30853 Langenhagen, Germany
Email: contact@cabalspy.xyz
Telephone: +49 511 7663766
VAT ID: DE353646120 (§ 27a UStG)

Full provider identification is available in our Legal Notice. These Terms are written in English for our international users. The contract language is English.

2. What the Service is

CabalSpy Alpha is a read-only information service. It shows token calls generated by our systems together with aggregated public blockchain data about wallets we label as "KOL" or "smart money". Access is sold per blockchain and is delivered as a role in our Discord server, which unlocks the corresponding channels and the web dashboard.

We do not hold, transmit or take custody of funds. We do not operate an exchange or wallet and we never execute trades on your behalf. We will never ask you for a seed phrase, recovery phrase or private key, and we never ask you to sign a transaction or approve a token allowance.

3. No financial advice, and the risk you take

Nothing in the Service is financial, investment, tax or legal advice. The data is published for information only. We are not a licensed investment firm and do not provide investment advice, portfolio management or investment recommendations within the meaning of financial regulation.

Trading crypto assets carries a high risk of total loss. Prices are volatile and past performance says nothing about future results. Signals may be wrong, delayed, incomplete or based on faulty third-party data. You alone decide what to buy or sell, and you alone carry the result. Never trade with money you cannot afford to lose.

4. Who may use the Service

You must be at least 18 years old and have the legal capacity to enter into contracts. You need a Discord account and must be a member of our Discord server to receive access. You are responsible for keeping your Discord account secure.

You may not use the Service if sanctions or the law of your country prohibit it.

5. Plans, prices and payment

Prices are shown on the access page before you buy and are stated in US dollars. The price that applies is the one displayed at the moment you complete the checkout. Where required, statutory VAT is shown and charged at checkout.

Payment is processed by Stripe Payments Europe, Ltd. We never see or store your full card details. Payment in cryptocurrency may be offered via MoonPay, a separate company with its own terms and privacy policy.

Launch pricing is an introductory price for a limited period, clearly marked with its end date. It is not a reduction of any previously charged price. After that date the regular price applies.

6. Subscriptions and renewal

Weekly, monthly and three-monthly plans are subscriptions. They renew automatically at the end of each billing period at the then-current price for that plan, until you cancel. Lifetime access is a single payment with no renewal.

You can cancel at any time, with effect from the end of the current billing period, through the "Manage or cancel" link on the access page, which opens Stripe's customer portal. Cancelling stops future charges; it does not refund the period already paid for. Your access and Discord role remain active until the period ends and are then removed automatically.

If a renewal payment fails, Stripe retries. If it ultimately fails, the subscription ends and your access and Discord role are removed.

7. Delivery and when performance begins

Access is delivered immediately after successful payment: your Discord role is assigned automatically, usually within seconds. Because of this, you are asked at checkout to expressly agree that we begin performance before the withdrawal period ends, and to confirm that you understand the consequences. See our Withdrawal Policy for exactly what that means for your rights.

8. Right of withdrawal

If you are a consumer in the EU, you have a statutory right of withdrawal. The conditions, the consequences of your consent at checkout, the compensation you may owe for the period already used, and the model withdrawal form are set out in full in our Withdrawal Policy, which forms part of these Terms.

9. What you may and may not do

Your access is personal. You may not:

  • share, resell, sublicense or publish the calls, channel content or dashboard data;
  • share your Discord account or let others use your access;
  • scrape, automate, mirror or bulk-export the Service, or build a competing product from it;
  • circumvent access controls, or attempt to obtain access you have not paid for;
  • interfere with the Service, its infrastructure or other users.

If you breach this section we may suspend or terminate your access without refund, and remove your Discord roles. For serious or repeated breaches we may also ban your account.

10. Availability

We aim for high availability but do not guarantee that the Service is uninterrupted or error-free. The Service depends on third parties, including Discord, Stripe, blockchain nodes and data providers, whose outages are outside our control. Maintenance, changes and temporary interruptions are possible. Data may be delayed, incomplete or incorrect.

We may change, add or discontinue features. If we permanently discontinue a chain you have paid for, we will refund the unused remainder of your period for that chain on a pro-rata basis.

11. Liability

We are fully liable for damage arising from injury to life, body or health, for intent and gross negligence, under the German Product Liability Act, and where we have given a guarantee.

For slight negligence we are liable only for breach of a material contractual obligation, meaning an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely. In that case our liability is limited to the foreseeable damage typical for this type of contract.

Any further liability is excluded. In particular we are not liable for trading losses, missed profits, decisions you make based on the Service, or for the accuracy, completeness or timeliness of the data.

12. Term and termination

Subscriptions run for the chosen period and renew unless cancelled. Both sides may terminate for good cause. We may terminate immediately if you breach section 9 or if we are legally required to do so.

13. Changes to these Terms

We may change these Terms where there is a valid reason, for example changes in law, in the Service, or in our costs. For subscriptions, we will notify you by email or in Discord at least 30 days before the change takes effect. If you object before the effective date, the change does not apply and either side may terminate the subscription at the end of the current period. Your continued use after the effective date counts as acceptance.

14. Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the German Consumer Dispute Resolution Act (VSBG). The European Commission's Online Dispute Resolution platform ceased operation on 20 July 2025.

15. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in the EU, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence.

If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is our registered place of business.

16. Severability

If a provision of these Terms is or becomes invalid, the remaining provisions stay in force.
